Practical Experience: An Overview
The principals of BCC have been involved in dumping and subsidies investigations undertaken in Australia and New Zealand, acting either for the applicant, or one of the respondents. This involvement has included third country dumping investigations.
Our work has covered all aspects of dumping, subsidy and safeguard investigations, with a particular emphasis on the preparation of material injury arguments and the analysis of financial accounts.
BCC has provided specialist input to articles and commentaries written by a variety of international practitioners. We have contributed to a leading international publication on dumping.
BCC has had considerable input into various amendments to the dumping, subsidy and safeguard legislation in Australia and New Zealand and has worked closely with Government officials and Parliamentary Select Committees to achieve desired changes. Similar work has been undertaken with respect to Customs’ legislation, Food standards and product standards.
We have a sound working knowledge of the WTO systems and procedures and maintain regular contact with developments taking place in that forum. BCC’s input has been sought by US firms representing parties in the dispute settlement procedures in the WTO.
BCC has been active in promoting the integration of consistent regional trading policies as a result of bilateral and plurilateral economic partnerships.
BCC has addressed various seminars over a number of years on trade remedies mechanisms, preferential trade agreements and Customs issues.
BCC has provided private briefings and seminars on trade and regulatory issues to a number of large corporations, both in Australia, New Zealand and other countries.
BCC provided input to the successful party in the major New Zealand legal precedent on the trade remedies legislation and has acted for parties in several cases on Customs valuation. We have also acted for parties involved in litigation with the Crown which has resulted in settlement prior to the formal hearing.
BCC’s expertise has been used in formal appeal processes in Australia and New Zealand.
